Amour Eunoia – Terms of Service

These Terms of Service (“Terms”) govern your use of Amour Eunoia’s website, services, and any photography, video, creative, talent, or modeling services provided by or through Amour Eunoia (“Amour Eunoia,” “we,” “our,” or “us”).

By booking services, submitting content, or using our website, you agree to these Terms.

1. Intellectual Property & Ownership

All photographs, videos, visual media, website content, graphics, logos, text, and related materials (collectively, “Content”) are owned by Amour Eunoia or its licensors and are protected by intellectual property laws. Amour Eunoia and its Crew reserve the right to use captured images and videos for promotional purposes, including portfolios, websites, social media, marketing materials, and publications.

Photography & Creative Work

• Amour Eunoia and its Crew retain full copyright and ownership of all photos and videos created during sessions.

• Clients and Talent are granted a personal, non-commercial license to use delivered images for personal use (e.g., social media, portfolios, prints).

• Any commercial use requires a separate written agreement.

2. Use of Talent Images by Third Parties

Third parties (including brands, agencies, production companies, or collaborators) may only use images, videos, or likenesses of Amour Eunoia Talent under a separate written agreement.

No third party may:

• Sell, license, distribute, or commercially exploit Talent images

• Modify, reproduce, or republish Amour Eunoia Content

• Use Talent likeness for advertising or promotional purposes

Without express written authorization from Amour Eunoia.

3. Website Use

You agree to use the website lawfully and not to:

• Copy, reproduce, mirror, distribute, or commercially exploit website Content without permission, including data and image scraping for Artificial Intelligence Services. 

• Attempt unauthorized access to servers or data

• Introduce malicious code, viruses, or harmful technologies

• Use the website in a way that interferes with its performance or other users

Amour Eunoia may suspend or terminate access to the website at its discretion.

4. Bookings, Payments & Cancellations

• Full payment is due by the agreed date.

• Deposits are included in the total session fee and applied toward the final balance.

• Cancellations or rescheduling must be made at least 72 hours in advance.

• Late cancellations may result in forfeiture of deposit or additional fees.
  
  

5. Delivery & File Management

• Expedited editing may be included where specified, and may not always be allowed. Expedited services may result in separate contracts or additional fees.

• Additional edits beyond the agreed scope may incur additional fees.

• Albums and online galleries may be removed after a designated access period, and are not guaranteed to be archived.

• Clients are responsible for downloading and backing up delivered files in a timely fashion.
  
  

6. Liability

Client Responsibility

Participation in any shoot or service is at your own risk. Amour Eunoia is not responsible for injuries, accidents, or damages occurring during sessions.

Service Limitations

While we take reasonable steps to safeguard media files, technical failures can occur. In cases of unrecoverable loss:

• If a portion of service cannot be delivered due to technical failure, only the successfully delivered portion will be charged.

• If complete recovery is impossible, the affected service fee may be considered for a discounted price or reduced fee.
  
  

To the fullest extent permitted by law, Amour Eunoia is not liable for indirect, incidental, or consequential damages arising from use of our services or website.

7. Submissions & Applications

Any materials submitted to Amour Eunoia (including applications, scouting submissions, or creative content):

• Must be accurate and lawfully provided.

• May be reviewed, stored, or discarded at Amour Eunoia’s discretion.

• Grant Amour Eunoia a non-exclusive, royalty-free license to review, evaluate, or publicize submitted materials for business and marketing purposes.
  
  

If accepted as Talent, portions of submitted materials may become publicly viewable.

8. Third-Party Links

The website may contain links to third-party websites. Amour Eunoia is not responsible for third-party content, policies, or practices. Accessing third-party sites is at your own risk.

9. No Reliance

Website content is provided for general informational purposes only. Amour Eunoia does not guarantee that all content is accurate, complete, or up to date.

10. Indemnification

You agree to indemnify and hold Amour Eunoia harmless from any claims, damages, losses, or liabilities arising from:

• Your misuse of the website

• Your breach of these Terms

• Unauthorized use of images or Content

11. Governing Law & Dispute Resolution

• Crew members (including photographers, videographers, editors, and other creatives) retain the right to use photos or visual media captured during sessions for promotional purposes, including portfolios, websites, social media, and publications that may or may not be affiliated with Amour Eunoia.
  
  

• Photos or media will not be sold or licensed to third parties without explicit written consent, except for the promotional uses described above.
  
  

• Images of Talent will not be sold or licensed to third parties without explicit written consent in the form of a written agreement approved by Amour Eunoia.
  
  

4. Sharing of Information

We do not sell or rent personal information to third parties without consent. 

We may share information:

• With affiliated companies within the same corporate group or contracted parties that are clients of Amour Eunoia

• With service providers who assist in operating our Website or services (under confidentiality obligations)

All photos taken are intellectual property owned and distributed by Amour Eunoia or Licensed to Amour Eunoia.

Amour Eunoia reserves the rights and/or has explicit permission to publicise the intellectual property used on this Site. You may not (re)publish any content on this website without explicit permission in the form of written agreement. It is expressly prohibited to scrape, copy, use, or employ any of the content on this Site for the training of, or supplying of content to, any artificial intelligence program or machine learning technology of any kind, including any and all technologies capable of generating works in the same style or genre as the artist whose artworks appear on this site or any platforms, including portfolios and social media accounts affiliated with clients, talents, or crew affiliated with Amour Eunoia. You may not claim any photos taken by  lients, talents, or crew affiliated with Amour Eunoia as your own. Our Products, Prints, and Imagery are  protected by copyright and are not permitted to be resold under a false tense of ownership or creation by people not associated with Amour Eunoia.
